Default Right of Way Rules?

I just started kiting in May. But I'm still a little confused over right of way. I've been a sailor all my life, and it seems like the rules are a little different while riding a kite.

I tend to just 'give in' if someone is coming right at me...

So... Downwind rider has right of way? Is that the deal?
