Do you have proof he received delivery of the items?

If you do have proof, then you have full legal recourse to collect payment or have the kites returned.

However, if you do not have proof of delivery, and I mean a signed receipt, and you claim he did this, and then put his personal information on the web, whether he received the kites or not, he can sue you or your business.

You need to be smart with your approach.

And for future shipments, there are ways to fully cover your business for any shipping issues.

If you did send out three expensive kites without requiring a signature for receipt, that was your first mistake, don't follow it up by making a second serious one...

I agree that if this guy kept these kites he is totally lame.
But, I think Greg is right here.
Proving he received the kites might prove difficult on this one. This could come back to bite you in the butt if this guy is a real lamebo and actually decides to step it up a notch and sue (if that is indeed a possibility).
I would figure out the specifics before you go much further.
A lamebo is a lamebo. Only mess with them if you know you can win. They will use any trick or out to do the wrong thing and unfortunately, this makes it hard to force them to do the right thing.
